1. Agreement to Terms

By accessing or using the Coach Kyle Richardsonwebsite (“Site”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

2. Services

Coach Kyle Richardson provides private 1-on-1 baseball coaching and training services for youth athletes in the Fort Wayne and Northeast Indiana area. The Site allows visitors to learn about our services, view pricing, submit inquiries, and request session bookings.

3. Booking & Payment

  • Session bookings submitted through the Site are requests and are not confirmed until Coach Kyle responds with a confirmation.
  • Pricing displayed on the Site is subject to change. Final pricing will be confirmed at the time of booking.
  • When payment processing is enabled, payments will be securely processed through Stripe. You agree to Stripe's terms of service when making a payment.

4. Cancellation & Refund Policy

  • Cancellations with 24+ hours notice: Sessions may be rescheduled at no charge.
  • Cancellations with less than 24 hours notice: The session fee is forfeited unless an emergency exception is granted at Coach Kyle's discretion.
  • No-shows: The full session fee is forfeited.
  • Multi-session packages: Unused sessions in a package do not expire but are non-refundable and non-transferable.
  • Coach cancellations: If Coach Kyle must cancel a session, it will be rescheduled at no cost to you.

5. Assumption of Risk & Liability Waiver

Participation in baseball training involves inherent physical risks, including but not limited to muscle strains, sprains, fractures, concussions, and other injuries. By booking a session, you (or the parent/guardian of the participating athlete) acknowledge and accept these risks.

To the fullest extent permitted by law, Coach Kyle Richardson, Kyle Richardson, and any affiliated facilities shall not be held liable for any injury, loss, or damage arising from participation in training sessions. A separate liability waiver may be required before the first session.

6. Parental Consent

All athletes under the age of 18 must have a parent or legal guardian submit the booking request and provide consent for participation. By submitting a booking request for a minor, the parent or guardian confirms they have the authority to do so.

7. Photo & Video Release

Training sessions may be photographed or recorded for instructional purposes (e.g., video review, form analysis). Any photos or videos shared publicly (on the website, social media, or YouTube) will only be done with prior consent from the athlete's parent or guardian. You may opt out of any public use at any time by contacting us.

8. Intellectual Property

All content on this Site — including text, graphics, logos, images, videos, and design elements — is the property of Coach Kyle Richardson and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without prior written permission.

9. User Conduct

When using the Site, you agree not to:

  • Submit false or misleading information through any form.
  • Attempt to gain unauthorized access to any part of the Site.
  • Use the Site for any unlawful purpose.
  • Interfere with the proper functioning of the Site.

10. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Site will be error-free, uninterrupted, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Coach Kyle Richardson shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or services, regardless of the cause of action or theory of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Allen County, Indiana.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the updated terms.
